The second hearing in the CBSE vs Mamta Sharma case has been concluded. K K Venugopal, the Attorney General, represented the government in the hearing which was presided over by Justice AM Khanwilkar along with Justice Dinesh Maheshwari. The petition was filed by Adv Mamta Sharma for cancellation of the class XII board examinations amid the Covid-19 pandemic.
The AG said to the bench that the final decision will be declared within
the next two days, and sought for a hearing on Thursday, to which the bench has
agreed. The bench directed the AG to give concrete reasons if the government
diverges from the last year's methodology. "No issue. You take the
decision. You are entitled to it. If you are departing from the policy of last
year, then you must give tangible reasons for it", the bench directed the
AG.
The government is still mulling over conducting exams and a final
decision is expected by Tuesday, June 1. Recently the CISCE has asked all its
affiliated schools to send the marksheet of class XI and XII by June 7 which
can be treated as an indication towards cancellation of exams. Adv Mamta
Sharma has also requested the court to expedite the process so that it can
relieve students of the anxiety and they can proceed with further career-oriented
courses. The Bench has adjourned the court till Thursday, June 3.
With more than 8000 children being affected by the Coronavirus in just one
district of Maharashtra, the state officials have predicted that the third wave
of the pandemic can be seen by end of July or the first week of August in the
state, which has resulted in further chaos among the students and their
parents.
